User Agreement
This User Agreement ("Agreement") governs your use of the Boco mobile application ("App") and related services. By accessing or using the App, you agree to be bound by the terms below.
1. Introduction
Boco ("we", "us", or "our") provides a private family diary application designed to help users capture and store family moments, create family member profiles, track growth records, and document family events ("Services"). This Agreement is a legal contract between you ("you" or "User") and Boco regarding your use of the App and Services. By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this Agreement and our Privacy Policy.
2. Eligibility
To use the App and Services, you must:
- Be at least 13 years of age, or the age of majority in your province or territory of residence, whichever is older
- Have the legal capacity to enter into this Agreement
- Reside in Canada or comply with all applicable Canadian laws and regulations
- Provide accurate, current, and complete information when creating an account (if required)
3. User Accounts and Profiles
You may need to create an account to access certain features of the App. You agree to:
- Maintain the confidentiality of your account credentials
- Be responsible for all activities that occur under your account
- Promptly notify us of any unauthorized use of your account
- Provide accurate and complete information for family member profiles
We reserve the right to suspend or terminate your account if you violate any terms of this Agreement or if we suspect fraudulent or unauthorized use of the App.
4. Data Privacy and Security
Your privacy is our priority. Consistent with Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation:
- All data collected through the App is stored locally on your device and is not synced to any cloud service
- We do not collect, process, or share your personal data or family information with third parties without your explicit consent
- You are solely responsible for maintaining the security of your device and any backups of your data
- We implement industry-standard security measures to protect the App and prevent unauthorized access

5. Use of the App
You agree to use the App and Services only for lawful purposes and in compliance with this Agreement and all applicable laws. You shall not:
- Use the App to store, transmit, or share illegal, harmful, defamatory, or infringing content
- Attempt to access, modify, or interfere with the App's code, functionality, or security features
- Use the App in a way that could damage, disable, overburden, or impair the App
- Share or distribute the App without our prior written permission
- Use the App to violate the privacy or rights of any third party
6. Virtual Coins and Premium Features
The App may include virtual coins ("Coins") that can be used to access premium features. You agree that:
- Coins are virtual items with no real-world value and cannot be exchanged for cash or other real-world currency
- Coins are non-transferable between users
- We reserve the right to modify the availability, pricing, and features associated with Coins at any time
- Purchases of Coins are final and non-refundable, except as required by applicable Canadian law
- We may revoke or suspend your access to Coins if we suspect fraudulent activity or violation of this Agreement
7. Intellectual Property
All intellectual property rights in the App, including but not limited to software, design, logos, text, graphics, and trademarks, are owned by or licensed to Boco. You acknowledge that you have no right, title, or interest in the App or its intellectual property, except for the limited license granted under this Agreement.
You retain all rights to the content you create and store using the App (including photos, notes, and family data). By using the App, you grant us a limited, non-exclusive, non-transferable license to use such content solely to provide and improve the Services.
8. Limitation of Liability
To the maximum extent permitted by Canadian law:
- Boco shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or Services
- Our total liability for any claims arising out of this Agreement shall not exceed the amount you paid (if any) to use the App's premium features
- We shall not be liable for any loss or corruption of data stored on your device, including but not limited to family photos, notes, or profile information
This limitation of liability shall not apply to damages arising from our gross negligence, willful misconduct, or violation of applicable law.
9. Termination
We may terminate or suspend this Agreement and your access to the App at any time, with or without notice, if:
- You violate any term of this Agreement
- You engage in fraudulent or illegal activity
- We discontinue offering the App or Services
Upon termination, you shall cease using the App, and any licenses granted under this Agreement shall immediately terminate. You are responsible for backing up any data stored in the App prior to termination.
10. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of Canada and the province or territory where you reside, without regard to its conflict of law principles.
Any dispute arising out of or relating to this Agreement shall first be addressed through good-faith negotiation. If the dispute cannot be resolved through negotiation, either party may submit the dispute to mediation in accordance with the rules of the ADR Institute of Canada. If mediation is unsuccessful, the dispute may be brought before the courts of competent jurisdiction in your province or territory of residence.
11. General Provisions
- We may modify this Agreement from time to time. We will notify you of any material changes by posting the updated Agreement in the App or via email. Your continued use of the App after the effective date of the updated Agreement constitutes your acceptance of the changes.
- This Agreement constitutes the entire understanding between you and Boco regarding the App and Services, superseding any prior agreements.
- If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- You may not assign this Agreement without our prior written consent. We may assign this Agreement without your consent.
